Liberty can go pound sand. They've done nothing but whined during this whole process.

Agreed, and IMO they are fighting a losing battle anyways.

The hearing on this is(was) today Channelside Bay Plaza's fate could be decided in pivotal court hearing

Quote:
Today, the judge could approve the auction and award Channelside to Vinik.

Or the judge could hear arguments and issue a ruling later.

But if the judge declares the auction invalid, that would restart the clock on a process that has dragged on for almost a year now.

Good summary of the action from TBO

I really don't see what leg this other company has to stand on - they showed up but didn't bid, then accuse everyone (including those running the auction) of colluding against them. It's not in the auctioneers best interest to collude against someone running the bid up.

Your right Sotnos. I would be shocked if the judge didn't tell them "tough luck you had the opportunity to bid and it was you that choose not to".

On the witness stand, Govindaraju said he did not attend the July 2 auction, but said he was receiving text message updates and had “grave concern” about “what appears to be collusion among the other two parties,” i.e. the port and Vinik, because they did not bid against each other. “It was obvious to us,” he said, “that they were prepared as wingmen for each other.”

I'm sorry, but if I was the judge I would tell Govindaraju he had no standing as he did not attend and worse, he did not bid.
